Lack of reciprocity leads to Florida woman’s arrest for firearm possession

Last week Donna Marie Gracey was arrested for firearm possession after being stopped by police.  NJ.com reports that police stopped her due to the window tint of her vehicle, and an officer observed her Concealed Weapons Permit in her purse while she was searching for her documentation. According to the Frenchtown Police Department Facebook page, the firearm was subsequently found in her purse. Her permit had been issued by her home state of Florida, but New Jersey does not recognize any other states carry permits.

NJ.com includes a note regarding New Jersey transportation requirements, without noting that even possession in those circumstances may not be legal if Ms. Gracey was not within an exemption to the ban on possession.  In short, we are still left with many questions regarding both 4th and 2nd Amendment protections afforded Ms. Gracey.
